Eminent domain by project type

The project driving an acquisition shapes what is taken and how the loss shows up.

Get Help How acquisitions begin

A highway widening takes frontage and changes access. A transmission line takes a corridor and leaves the ground beneath it partly usable. A drainage scheme takes a low corner and can change what the rest of the parcel will support.

Identifying the project tells you which agency you are dealing with, which chapter of the General Statutes applies, and which parts of your value are most at risk.

Which chapter governs depends on the project. Highway work is the Department of Transportation under Chapter 136 Article 9. Most other projects run under Chapter 40A.
